Insurance claim
Well first of all I have to thank sunshine aka Gordon if it was not for him I’ll be stuffed
january 15 my boat was broken into and the good person that did it had done some damage to my boat. They smashed open the lock on the door and Silly me left 2 rods 2 reels and my tackle bag in the locked cabin all stolen they also stole my flares and platinum card out the gps/sounder combo unit they did try and steal my simrad nss12 but could not get it out of the dash so they smashed the screen and damage the dash also stole my stereo was pretty devastated. So did the normal thing called the cops they did nothing cause it been raining and then called the insurance company, got told what they wanted got the necessary quotes sent all the photos and quotes off thinking cool should here back soon asking for bank details but not this time was to ask questions where my boat was and was told they would be looking into it. Unfortunately couple days later the phone call I didn’t want and that was to be told they declined my claim very devastated now, thinking the worst that I am now massively out of pocket and not being able to afford everything. Ended up reading a few post and found sunshine and so happy I did we need more people like Gordon cause mate you are a legend and don’t think I would have had the outcome I did without you. After speaking with sunshine and explaining my situation he was more than happy to help and could not believe what was happening, gave sunshine all the necessary documentation and authority to speak on my behalf to the insurance company, off went the response letter from sunshine and then we had to wait a few nervous weeks wondering and waiting many emails back and forth plus phone calls and then got the phone call on Monday from sunshine and it that just made my day that insurance company had reversed the claim and have now accepted it and will payout for the damaged goods plus some stolen items. I can’t thank sunshine enough I could keep saying it over and over definitely wish there were more people like Gordon in this world you are definitely one in a million mate and I appreciate everything you have done for me and my family
hopefully have the boat back in the water very soon now thanks to sunshine can’t wait

Good stuff sunshine. insurance company’s are dogs. Had a similar experience with flooding in my house where water over shot the valley. I was at work and the missus rang me to tell me the ceiling had water pissing though it. I went home and got up on the roof to have a look and found two dried leaves of the willow tree in the valley where the water was hitting them and shooting over the side of valley. I removed them and all was good. Couple hours later the insurance contractor came to tarp up the roof. I told him what I found and that I removed the leaves and all was good.
When I rang a few days later to see how my claim was going I was told it had been knocked back due to lack off maintenance. When I asked for an explanation they said there were leaves in the valley. When I asked them for proof like ie. photos after a couple of hours they rang back said that it had been approved. The fu**ers were trying it on.

Reason for declining claim
What was the reason given for initially declining the claim. Sounds pretty cut and dry on the face of it

a lot of the time it depends on where the boat/vehicle is parked, if out front it will be questionable if it was behind locked gates you have better chances

Time for me to chip in
The policy clearly and expressly states that there is NO cover when the boat is left on a road or verge, Hayden had parked it outside his place but like most residential blocks nowadays they have very little frontage and the insurer sought to rely on that exclusion to deny the claim. His car was indeed on the verge, indeed it was on the artificial lawn Hayden had installed but the boat or at least a part of it was arguably within the boundary of Hayden's property which was the argument I presented when seeking to have the denial overturned. I also pointed out that their own website displayed a boat out the front of a home on the driveway and therefore they had pictorially represented that boats were covered in such positions.
I think it helped that the manager I corresponded with happened to be a small boat owner.
As a now retired claims manager with 44 years in the game I can say that ALL the claims staff I trained were told from day one that it it their job to pay claims and, more importantly if the circumstances made a decision "grey" then the decision was to PAY .......regretfully it seems that has changed to deny first. If I can help anyone on here with insurance claims issues they should not hesitate to send me a pm .....any type of claim as whilst I was considered to be a marine expert I also have skills in property, BI and most other classes.

Bit like a mate of mine recently hit a roo in his Hilux, done damage and the insurer asked him to prove he hit a roo. Fortunately he had a dash cam, or he might have found himself high and dry and forking it out from his own pocket.

My mate hit two Roos in
My mate hit two Roos in separate incidents on the way to work at Alcoa. He tol$ the insurance company this and they made him pay two excesses as the car was damaged front and back as one roo jumped into the rear quarter.

You do not have to prove anything
The onus of proof that a policy exclusion applies rests heavily on the insurers shoulders ! And thankfully the Insurance Ombudsman now provides a last line of dispute resolution but even so just how you present your side of the case is often critical, use the wrong words and you can get into strife which is why I offer to help !

But still help where I can, the insurance industry has been good to me and I keep being asked to make presentations and provide training but bluntly 44 years is enough......life is way too short, having worked for almost two decades around the world for a US insurer who paid big super when in oz it was only 3% I am comfortable and ticking off bucket list items.
But for this on line community where everyone helps each other I will go out of my way to assist!

Wow great work sunshine for helping out. Since you pay your insurance premiums, I'm glad you were able to make a successful claim. Great story, but the description of the crime made me angry. Guys who wanna steal stuff and also damage what they can't steal. I hope it catches up with them one day

I've been through a similar situation where (not mine but a family members boat i was using) trailer was stolen from a car park down south. Took sometime and a few heated phone calls to get a payout on a 6 month old trailer but got there in the end.

Legendary effort Sunshine. I just had my insurance claim paid out for my lost 2x combos and damaged rocket launcher and bimini when my rocket launcher exploded. They denied the braid, my GoPro and a damaged guide on another rod and couldn't imagine the stress of the entire claim being denied.

Sorry guys didn’t want to say anything till it was 100% sorted
so as said in January good people broke into the bout out the front of my house i live on a corner block and my hole house takes up my block so there no way of getting the boat down the side plus a limestone blocks around the hole house so I had it attached to my car on the lawn they declined the first claim saying it was on the verge but It was not I’m with rac and anyone with them may want to make sure it’s ok where ever you have your boat as there website says once you dig very deep into there policy’s they won’t cover a boat on a verge so be careful guys. If it was not for sunshine I was toast didn’t no where else to look or go so many thanks to him what a legend. Now it’s all settled and I can get the boat on the water once she is fixed up. a lot of worries going on as I don’t have the spare money to fix it. I’m happy I get to replace my items I still losing out 3k as they won’t cover everything stolen from the cabin but it’s better than nothing
items to keep a lookout for is a tiagra 30 plus a shimano revo offshore, boxes of hard body lures yozuri,halo,rapala deep divers plus duo squid jigs navionics platnium card fusion stereo heaps of jig heads okuma rod and reel, 4 filleting knives swibo and victorinox there mainly the high places items that are not being replaced by the insurance company but will be doing a new policy and making sure it will be covered if it ever happens again I really hope not that’s for sure
