Another hypothetical question

Another Hypothetical regarding grayzees post.

I was out fishing with a couple of mates up in exmouth (five licences in total). We'd been having a good day, with most of us catching our fair share of table fish. On the way back to the ramp, the skipper pulls up for a swim and a beer as its still early. I decide I'd throw on a mask and have a look around. I grab the speargun and as soon as I hit the bottom, a nice coral trout swims up to greet me and is dispatched and on ice within seconds.

Now I look back down and there's four of his mates wondering what the commotion is all about.  Now I know I'm only allowed to take one coral trout per day, but we have five licences on board.  So I swim back down and nail the other four in quick succession as I know my mates wouldn't be able to hold their breaths long enough to get a shot away.   Now this question is to the people that said it was ok for two divers to catch 3 people's crays.

Is it ok for 1 person to spear five people's limit of coral trout??

 i think its a complicated situation as you are catching catching 5 times your limit but then again the boat limit was all good. probably one of those depends on how the fishieries officer is feeling type things

I dont see a big issue with it. Legally maybe not ideal (Wouldnt know) but if the boat limit isnt exceeded, I dont see an issue with who actually catches/spears them. Ive been out plenty of times and 1 guy has caught most of the fish, but we go on number of anglers' limit - 1 guy catches 4 reds but divided between 3 blokes. Otherwise you would realistically have to let fish go once you have personnally caught your individual limit.

 Same question mate.Why not?  We go out at Gnaraloo I catch our Red limit for the day poor deckies get none. Are the fisheries going to ping us back at the beach? No. The answer to your question ia a moral not a legal one.

It all depends on if the officer has seen you spear the fish because once the second fish has been speared by you then you are breaking the law on personal daily tally.

Agree its a moral question, no different to 2 guys landing 16 tailor on a

overnight trip with no cold storage , It is legal but the tailor will prob go off and be wasted.

The reason its not a legal question is i.m.o , is after reading the 36 page rec fishing rules/ guide

for the west coast bioregion , again nowhere in that publication, which you are sent to if seeking rules

for fishing in W.A . does it say the only way to achieve your bag limit is to induvidually catch it yourself.

( crays , abs etc etc all have there own guides and indiv rules) Im talking fish here.

 

In fact the only mention thats relevent is to say that if only 1 person on board a boat  possess,es a rec

boat licence others can fish and land fish all under that 1 dudes licence as long as 1 bag limit isnt exceeded.

ie. Dad has a rec boat lic, takes mum and 2 kids out for a tailor troll off canning bridge. Dad gets 2 , mum gets 2

both kids get 2 each , bag limit of 1 has been reached , go home ( hopefully mum knows how to fillet! )

So in there own publication they are condoning / admitting that just because you have 1 persons bag limit on the boat , you personally may have not caught them all.

They are bag /poss limits , size limits , and boat limits, with no mention of CATCH limits, thank god.

Lets not talk about it any more , agree with others on the cray post that started this , let sleeping dogs lie,

before the guide becomes a 100 page novel.

Not legal. What if it was a fishing competition ? Is it ok to weigh fish in a competition that you did not personaly catch/spear? Unfortuanatly many participants of competitions think that it is ok to weigh in fish they didnt catch. In my opinion this is why fishing competitions/competitors are scarse nowdays. People are ignorant of the rules/law. I know of fish swaping in competitions aboard boats and even between boats. Cant belive people think its ok.

dont agree with what your saying about fishing comps there high noon, well at least dont tar them all with the same brush, sure there have been cheats caught and all cheats get caught eventually.  I fish with 2 clubs one beach and one offshore and the members have high standards and sleep well at night fishing withing the club competition rules, we enjoy fishing competitively for no or very small prizes and the glory is the grin the winner gets and respect from fellow anglers.  I wouldnt consider comps to be scarce its just big prizes arent on offer at many comps(there are some) so its gets back to angler v angler not prize hoohaa.  head along to a AAA weigh in and you will be surprised at some of the bags weighed in by some very skillful anglers.

whats competitions got to do with it?

Im not into the club or competition side of fishing but unless the prizes are substantial such as in the US, why would you cheat?

At the end of the day only one person is fooled.

 

Spearing/catching-while the original example is extreme and trying to make a point, I have no problem with it.

Go back to a point I and others have made previously-is the decrepit old war vet or handicapped kid only entitled to a fish if he can physically carry out every part of the operation himself?

 

Just get on with it the way you feel right doing it, stay inside limits and stop worrying so much about others doing insignificant stuff you might not like.

We always fish to the boats bag limit. Quite often one person will be catchin alot more then the other. could be luck or skill but who cares at the end of the day on my boat the fish gets split evanly between everyone on the boat regardless of who caught what

Cant say i have ever had an officer ask me who caught what. I would have shot all five trout then got on the piss with the lads... just like the rest of you but are too ashamed to admit it

Many times i have been out on my boat targeting Dhuis with my mate(both of us have BFL) we always take the first two Dhuis(boat limit) we catch then leave, which has on many times out been either me catching the two or him catching the two. We always divide our catch to each take home a Dhui. I mean i am not about to catch one Dhui than sit back and wait for him to try and catch one. And other than undersized Dhuis i dont catch and release from the depths i fish.

 

Yep fish to the boat or onboard licence limit i reckon. Many times i take my missus out with me and she loses interest pretty quickly when having to wind back up from +60m and so i will continue fishing into her bag limit if i so choose to. In saying that though i still will only take what i/we need then stop fishing.

Personally if the boat limit is adhered to and bag limits how can someone prove who caught what really but in the case of the spearfishing if u got five trout i think u would need 5 sets of dive gear on board too.really if u got you bag and there was another license holder on board not catching would u then go screw u catch ya own or get him his entitled feed ?
