Crays - possession limits
righto - three different answers from fisheries to same question.
I asked the fisheries guy at the ramp last year, and both the missus and I have rung fisheries separately this year...
if you have 2 or 3 or 4 people in your household but only one has a cray licence, how many Crays can you have in your freezer and do they have to be labelled?
is the answer 24 ie only the max limit for the licenced person. Or can every person regardless of whether they have a licence or not have 24 in your household freezer?
one of the answers was “only 24 for the licenced person” another was “everyone in the house over 18 years of age can have 24 even if they don’t have a licence” and the best answer of all was “only the licenced fisher can have 24, and they have to be labelled, any extras are illegal. And if you label ones you’ve caught with your missus’ name and she hasn’t caught them then you can be charged with supply or sell!”

Funny you mention everyone you give a cray to being criminals too....the missus being smarter than me asked exactly that...”so if we give a couple to the folks at Xmas is that not allowed either?” The answer from the nice female fisheries officer was and I quote “so long as we’re not there haha, or so long as you’re there when they consume them then it’s okay haha”....
....otherwise I assume they are possessing and i’m supplying...
its a shame the fisheries guide given its now war and peace in length can’t clarify.
I was always with you...once they’re landed then they’re yours to give away so long as you don’t sell...that is for wet fish or crustaceans...clearly not clear if you shop your answer around.
frustrating when people are legitimately trying NOT to do the wrong thing but can’t get a straight answer.

Fisheries really have to start getting it together with the information they disseminate if they want to continue to prosecute.

i was always under the impression to what Rob said about per person not licensed person in the house the same as fish .
if in any doubt about your limit you can off load some my way

Was good question Chrisg. You can phone 3 to 4 different fisheries office numbers. And get different answers all the time on any type of fishing subject.

It specifically says you "must have a license to FISH for any species of RL"
it also says a max of 24 PP with nothing stating anywhere near that about "that person" having a license.
also "not permitted to sell or use Rec caught RL for any gain or reward" so no telling the missus "I caught dinner how bout you wash dishes"
so PDF is pretty straight forward........just the Fisheries officers need to get up to date.

They dont within reason, hence you can only possess them at your place of residence and if caught elsewhere they are illegal.
Its a good rule change though, always stored tailed now...

Fisheries in WA are a joke.
We pay the highest license fees anywhere in Australia by a very long margin and they can't even train their staff to know the most basic of rules. They are too lazy to set fishing limits per species like they do in other states, instead they set blanket bans on all species. Then they go after small guys all the way to the supreme court on contraversial rulings where the impact on the fishery of the particular case at hand or group of fishers is miniscule (Carter).
I have no time for them whatsoever and just make sure that everything is in order on my boat.

Possession limits
This means the maximum number of rock lobsters you may have in your possession, even if they were not all taken from the sea on the same day. A possession limit of 24 rock lobsters per person applies, including at your principal place of residence.
Your principal place of residence does not include a tent, vehicle, boat or caravan (unless you live permanently in the caravan).
You must only be in possession of whole rock lobsters unless the lobster is being prepared for immediate consumption. However, you may now possess rock lobster tails (shell on), at your principal place of residence.
Rock lobsters MUST be transported whole. For this reason, it is illegal to take stored tails away from your principal place of residence, which is the only place where you may possess them.
I find the part I bolded the most ridiculous.
How many of us, or know of somebody who has/have broken this law ... (NB: please don't answer that.)
The problem is, the fisheries need some hard laws to allow them to prosecute those rat mongrels that are raping and pillaging crays.
Which is all well and good when the fisheries officers apply some common sense ... sadly, common sense doesn't always prevail resulting in the innocent finding themselves guilty on a technicality.

i sit and read rules all the time. Especially new additions. I don't actually think it is the officers fault on certain fishing subjects. ( rules) . The rule book can be twisted and interpreted in many ways , some officers may read and push issues they think is write in there mind. Then few days later get a different view. Fair few are simple to understand others are crap.and as pointed out ,think you have it correct, next minute your in court or fine. Years ago I got searched from fishing out deep ( snapper ban was on in sound). An elderly lady officer was teaching a newbie. Opens esky looks at newbie and says" right there is a snapper ban on, but the reason I know this gentle man hasn't caught this snapper in sound is because he has a nice coral trout a big pearl perch and a brown rock fish. I smiled .i was fishing rocko I had pink/dhue/black ass and Harley. I rest my case. Swimming in Cockburn ( of shore) not boat. ( thought I was going for crabs) she comes up to me and said. " been watching you for a while I realised you where not going for crabs after a while. What are they ( razor fish) oh what's the limit on those I smiled. Both true story's and not having a dig at all I put it down to training

The following is the response I recieved direct from Fisheries regarding the possession limits raised by ChrisG
"A person can be in possession of a maximum of 24 rock lobsters at their principal place of residence. You do not have to have a recreational rock lobster licence to be in possession of rock lobster. The rock lobster must be caught legally (ie: one person with a licence must only catch eight rock lobster a day, however he or she can ‘gift’ those rock lobster to a family member)
Four people who reside at a residence can all be in possession of 24 rock lobster each each, again provided they were caught legally.
For a person to be in possession of rock lobster they must have "knowledge and control" of the rock lobster (ie: a two-month baby would not have knowledge of RL therefore could not be in possession of them").
