Fisheries corruption
Submitted by dpost80 on Thu, 2008-10-30 13:21
The Corruption and Crime Commission (CCC) tabled a report this morning on the Investigation of Alleged Misconduct Concerning Officers of the Department of Fisheries. It is stressed that the CCC notes that these findings are matters of opinion only and ‘…is not to be taken as, a finding or opinion that Mr Millington a criminal or disciplinary offence’.

warning
Just a warning for anyone thinking of commenting on this, be very very very careful as nothings been proven yet and could open a whole can of legal worms. The dept does read this site and any thing said could be used against you. (has nothing to do with me, I'm just trying to make sure you guys are aware of potential consequences - I thought of taking this post down but assume someone will bring it up in due time)
Cheers,
Adam

More info
There's some info on the PerthNOW website under West Australian News - I won't quote it here per what Adam has just said. However, I do think it would be extremely premature to start broadbrushing.

Good one Jes
Umm, an opinion which is defamatory and not true to fact is LIABLE!!
But hey, I'm a little precious until he's proven guilty or the claims true....... Like I said, go for gold son.
In law, defamation (also called calumny, libel, slander, and vilification) is the communication of a statement that makes a false claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. Slander refers to a malicious, false, and defamatory spoken statement or report, while libel refers to any other form of communication such as written words or images. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. Related to defamation is public disclosure of private facts which arises where one person reveals information which is not of public concern, and the release of which would offend a reasonable person.

Early stages
As currently published on the Perth NOW website, what we have at the moment is a parliamentary report naming the acting chief executive officer with details on a tip off and the article goes on to name two departmental officers who are reported to have since left the department.
Obviously, without the need for premature judgement, it is a cause for great concern as echoed by the Minister's reported 'concern about the findings' and that (as reported) the Minister 'wanted (the reported acting chief executive officer) stripped of his position'.
Yes, reality is that, as a general comment and not on the report, you will, unfortunately, get corruption in public AND private enterprise. Historical prosecutions have removed that from doubt. Of course, that doesn't make it right, comfortable or avoids people being incensed about it.
One thing I'm sure, having worked in a large number of government departments, including WAPOL, (and as Big John said in another thread), there will always be bad apples. Fortunately, these are always in the minority and it's not a conclusive indicator of systemic organisational 'rot'. I think it would be very wrong to judge and promulgate otherwise. This would incorrectly hurt a lot of very passionate, dedicated and innocent people.
However; without specific judgement or prejudice, should anyone in a position of responsibility, be found to be usurping the credibility of that position and therefore bring discreditability upon that office / position, then they deserve to be held accountable for unnecessary and potentially uncalculable damage.

Yup
1)Pragmatically sad is not an alleged crime by a Public servant/s but something like world hunger.
LOL - That was about how I feel.
2)Great respect for dedicated and working people will never change its just the shit that gets found out as it tends to float!
Yup, true - but, under these circumstances, the overall good that people do tends to be forgotten about, or at least not focused on, or worse, can get usurped.
3)Genuine sympathy for the Fisheries Minister will be earnt as he will be judged by the decisions he makes and so far he has made some good ones.It is not his fault he has some alleged rotten eggs and no reasonable person will blame him for that!
Not his fault - absolutely. No reasonable person wouldn't - but we can't assume that everyone will be reasonable about that. Even with that asside, it's a headache that I'm sure the Minister could do without. Especially as he is still a (relatively) new Minister and has a lot of issues to consider.
The tabling of this is what he needs as he will be judged by it and may come out smelling of roses ....
Yup, and I'm sure he will act quickly and diligently through due (and required) process.

Minister responds to CCC report into misconduct allegations
Media Statement
“I have read the Corruption and Crime Commission’s report and am concerned at the findings,” Fisheries Minister Norman Moore said today.
“I take the report concerning acting chief executive officer Peter Millington seriously and, as recommended by the CCC, the matter will be dealt with by the Director General of the Department of the Premier and Cabinet.
“Mr Millington is currently on leave and I have sought to have his position as acting chief executive officer revoked.”

Correct me
if I'm wrong but I was under the impression that if you stated, "I allege that Mr X did so and so," that you couldn't get sued or has the laws changed, as on the TV you always here the news readers state the alleged crime or is it different for public servants, one law for them and one law for us the common folk, just a query and just my opinion???

You can state the facts
You can state the facts, but if you express your opinion which is derogatory, slanderous, liablious etc, then you could be in for trouble. For eg. If I was accused of a crime, and you call me a crook and I'm proven not guilty, I can sue you. (pretty sure thats how it works, but hey, I'm no lawyer so don't sue me)

It is a grey area
A rugby reporter I worked with reported that a player had put on a lot of weight during the off season. Despite clear evidence that the guy had packed on quite a few kilos, he won the defamation suit.

i allege that this is all a
i allege that this is all a load of hog wash...... i can walk up to an officer of the law and say " it is in my opinion your an asshole" and there is stuff all he can do about it.... yeah sure he can take me to court but as long as i state it is my "opinion" then there is f**k all he or the courts can do about it..... it is my opinion and my opinion alone..... why do you think everyone on this site puts in most of their posts "imo"???? get real people.... just imagine if the courts were all of a sudden back logged with people fronting the magistrate because they stated their opinion.....their would be no time for the courts to deal with the real criminals...... in my opinion some people on this site are full of it and need to wake up.....

LOL
Verbal conversation is different, its your word vs his word and difficult to prove. But if your going to write something, which can be printed, saved etc etc, then it can be easily used in a court of law against you.
