Fisher fined $25,000 for abalone haul

A Girrawheen man has been fined more than $25,000 for illegally harvesting 326 abalones off Ocean Reef last

 

As part of a Fisheries WA operation, Duy Cam Dao, 46, was under surveillance as part of a Fisheries WA operation at Ocean Reef beach on December 11.

 

Fisheries officers later apprehended him and found the massive haul in his backpack, including 13 undersize abalones.

 

Mr Dao was already banned from abalone fishing at the time of the offence and he harvested them during a prohibited period.

 

He appeared before Joondalup Magistrate's Court on Friday, where a judge handed down an $8000 fine for breaching the original 2007 court-imposed ban, $8600 for fishing during a prohibited period, $7200 for exceeding the bag limit and $1100 for the undersize abalone.

 

He was also issued a court order that banned him from being in possession of abalone.

 

Fisheries compliance manager Phil Shaw said it was a good result for the operation, which started in August 2012 in response to information from the public.

“The purpose of the operation was to identify people actively involved in either the illegal take or the illegal distribution of abalone in the metropolitan area,” he said.

Judge handed down the wrong penalty, should have been at least double and a few months inside getting a striped sun tan for good measure. It was not as though he didn't know or could plead ignorance.

I also think it is pretty lean considering what he did was malicious and with intent to far exceed the limit, and do it out of season.

Makes you wonder how many times he has done it before without being caught.

Well, reading this after reading an article how a P-plater who killed a guy in an accident when disqualified and with 5 previous drink driving offences walks free with less than $3000 fine, something doesn’t feel right. Not defending this “fisherman” he has done a wrong thing, but in a perspective, our judges/law is a joke.

It is good they threw the book at the abalone bloke but I have to agree with you on the P-plater that guy should have been sent to prision for several years at least, he killed someone doing something he had previously been in trouble with before. Yes the justice system in this state is a joke.

Have to agree that the legal system is a joke. Glad they caught the guy poaching abs and fined him, could have been even stiffer fines given repeat offence and the large number of abs. But it's seriously messed up that if instead he was drunk and had brain damaged or killed somone he might have got off with a slap on the wrist.

I reckon he would have to bring them to shore bit by bit, no way a dude can carry 300 abalones out in the ocean. I reckon the officers waited till he had a huge haul before busting him to make the lesson a big one. No point busting him with a few and him getting a warning. Good on them IMO
