Crab cleaning query
Have been discussing with a mate this theory today and not sure on the legalities
open to conversation
haven’t had a chance to catch a fisheries officer to quiz him
so when I’m crabbing once im home I process my crabs by peeling the shell off and cleaning them before cooking as I steam them and have found it’s much cleaner when eating without all the shell and guts
so here’s the question
once I’ve landed back on the beach with my crabs which are sized and within bag limits, can I clean them on the beach and take home my processed crabs putting the shells back in the water? They come from the ocean can’t see the difference to filleting a fish for strip bait and returning the carcass
Wheres the point where a catch is ‘landed’?
as I said open to see what people think as I haven’t don’t this yet but will save me from
dealing with all the offal once home
cheers

Hard to say as the crab is actually measured across the shell, which you want to dispose, I think it would be the same as just keeping cray tails which is not permitted. Just my take on it.

I used to load all the shells
I used to load all the shells and offal into plastic bags
they aren’t available anymore so I’m looking at alternatives
Peter not interested in keeping crab shells and dale I think you’ll find they have changed the laws to allow you to keep tailed Crays at home, but I get what you mean as in landing tailed Crays ...I may be wrong
my other thought was to keep the shells until im done as that would show they are not undersize

That rule changed last year
That rule changed last year (?) Dale. You can now keep full cray tails (shell on) at your home.
For the Crab's always a good idea to check out the fisheries documents.
http://www.fish.wa.gov.au/Documents/recreational_fishing/additional_fishing_information/rules_guide_crabbing_west_coast.pdf
On the first page it mentions that uncooked crabs must be kept whole untill just prior to processing.

I live 50m from the sand
I live 50m from the sand ramp
can see the crab Cooker basically
so you would classify landing the crabs as being at home not the beach?

Old chesnut.
I think its just another one of those end less rules , that fisheries officers try out on the spot and work out in court later.
One officer at your driveway , might consider them taken and off to immeaide prossessing , the next could say hang on your still in transit ,
and I wish to measure them which I cant do cause you just shelled them , your busted.
Call me a old fool , but I lay awake at night sometimes imagining how simple it was to be a fisherman in WA In say the 1950,s , no tickets , no lic , no rules , no court cases over stupid sh,,,t
It must have been pure joy.

Yes, I understand that, but I was implying bringing crays back to shore tailed.

Yeah that’s a point still
Yeah that’s a point still trying
I just struggle to see the difference between this and cleaning my fish at a filleting station at a boat ramp, cutting my
fish into smaller portion sizes for cryovacing and then fisheries rolling up and asking to see the catch
cant really prove size then either

fillets must have skins on and greater than 30cm
Again, from what I understand from the Fisheries, if you are going to clean your fish (demersals) at a filleting station, not your place of residence, then you still need to keep skins on and ensure those fillets are greater than 30cm (for demersals).
If not, you could be up for a fine from a prickly Fisheries Officer.
It follows the same rules when doing a live on board charter or an extended fishing trip away from your normal residence. All demersal fillets transported need to be 30cm with skins on. Once you get them home, then you can take the skins off and repackage as you wish, and then transport them to a friend's place.

When filleting at sea and
When filleting at sea and landing ......skin on
But have been voing to exmouth..coral bay for 30 years. Once at your tempory residence you can skin off and any size. Transport back to perth after the week or two have been checked by fisheries many times with no problems

take home first
From the fisheries website;
"All uncooked crabs must be kept in whole form, unless being prepared for immediate consumption."
In addition to that, I have had discussions with the Fisheries regarding friends who I take fishing and the rules once they leave my residence with processed seafood, at the end of a day's fishing expedition.
From what I understood, the fisheries are pretty particular about the rules until you get your catch back to your place of residence (or the residence from which you departed from on that day's fishing trip) ... after that, not so much.
That is, if I take a friend crabbing and we catch a combined total of 20 crabs (our limit of 10 crabs each), we must take them whole back to one or both of our homes before processing of any kind.
(NB: the exception would be if we decided to cook and eat all of them down the beach).
If we took all 20 crabs back to my home (place from which we departed for crabbing), cook the crabs, take the shells off, then my friend may even take all 20 cleaned crabs from my residence back to his.
Personally, I wouldn't encourage that, because if he was stopped by a fisheries officer in transit, he could still be fined on suspicion that he was in posession of more than his 10.
Subsequent witness statements from me stating I had given him my legally caught and processed crabs would likely lead to him having charges dropped.
The same principle applies for Crays, Dhuies, etc...
My question to the Fisheries was initially about my concern of a friend going out demersal fishing with me, and leaving my home with a number of Dhuie fillets with no skins on ... something that would be illegal if we were checked by a fisheries officer prior to getting back to my residence (from where we departed and where we would normally return to process our catch).
Obviously, this is just my understanding and should not be relied on without further consultation with the WA Fisheries.

if you live that close to
if you live that close to the beach clean them at home then take a walk after cooking the crabs to despose of the shell. no plastic bags needed just a bucket and a bit of energy .

1st, make your own
1st, make your own interpretation.
2nd, ask a mate.
3rd, ask a fisheries officer.
4th, ring fisheries back again because the first call didn't make sense, only to find the fisheries guy on the first call is saying something different to the guy on the second call.
5th, put it out on facebook - "Perth - buy and sell" is a good one.
6th, put it out on facebook again but this time on "Perth - have a whinge"
After the confusion hits home, head out for a feed of crabs only to be stopped by a fisheries guy who explains the rules. Now these rules do not match 1 to 4 as explained, you put forward the rules you know but alas this young kid from fisheries knows his "shit" !!
Put fine in back pocket and wait for phone call for court date.
You go to court and win that battle as even the judge has no idea of the rules.
Thinking that's over, fisheries appeal that verdict as their interpretation is different.
Anyway, off we go to the supreme court
Does this seem far fetched ??

No not one bit
I don't think your description or the likely out come of the above is a fairy tail. I seem to think I have read of a scenario exactly as above unfolding in the recent past.
Send them an Email and ask the question, request a reply on a fisheries letterhead paper.
Unfortunately, I think senility will overtake you before you get a reply, or the reply will have a caveat on the bottom stating something to the effect that the advice given here with is not to be taken as a lawful definition and may not be quoted as a defence should you be charged with an offence.
