busted big time
hi!! i need some help here and hope someone could give some insights..
it was my first time going crabbing with a few others. we went down to mandurah.. catching happily.. 6 of us catched approx 100 crabs. we didnt cared much.. thought that whatever we chatched, just put it on the bin first... as it was my first time i didnt know of any rules and license etc... we were still catching and chit chating.. didnt plan on leaving yet... so after some time.. the rangers came around to do some checks on our catchings.. and found that we had small and undersized crabs. i was shocked and the few others.. perhaps all of us were scared and nervous.. thinking that oh shit.. whats gonna happen to us.
so the rangers told us we have alot of under sized crabs... and we could be fined up to 10000 etc... and took all our crabs away..
happy and excited night turned out bad. really bad.
few weeks after, all of us received this fisheries infringement notice.. each of us receive 3 infringments. they are:
-s.46(b) FRMA - poss>b/limit tot/protect/fish cat 1 sp - $1000
-r.64L(1) FRMR - non-permitted means for taking crabs - $75
-s.50(3) FRMA - took > twice bag limit cat 1 fish - WARNING
we were at Len Howard Reserve, Mandurah.
can anyone please share your experience and please give some insights and advice on this. can we make an appeal or something or is there any way to reduce the fines??
can someone pls explain each of the infringements?

I think you have gotten away lightly- Rules are rules and they aren't hard to follow... Catch and size limmits are there for a reason (sustainability) and should be adhered to.

I highly doubt you can decrease the amount of the fine. They're in place for a reason and expensive to discourage people from doing the wrong thing.
Surely even for a first timer having approx 100 crabs seemed like to many?

youre a dumb shit. youre mentality has no place here.
pay the fine, and tell your mates to do the same. be thankful it wasn't more, and they didn't confiscate your car, etc.

Maximum fine is up to $5000
$70 for illegal fishing methods.
Warning for exceeding bag limit.
You could dispute this in court, but if you lose, and there is every chance you will, the cost will be much higher.

I went out on the weekend and caught four 20cm dhufish, this counts as a sized one doesn't it because it adds up to over 50cm of dhufish?
I'm not sure on the rules but I assume it is a combined catch that you add together?

Seriously it's everyone's obligation to ensure you have an understanding of the basic rules and regs before setting out and catchings (sic) 100 approx crabs. Considering this post is legit, this is the kind of stuff that really gets on my nerves. Claiming ignorance is no excuse. I moved here from another country at a young age and the first time my dad took me out fishing we ,made sure we knew the rules regarding size and bag limits for fish we were likely to catch. If we caught something we didnt recognise i went back in the drink regardless of size. No point coming here to look for sympathy, because the fine is bugger all, like a slap on the wrist consider yourself very lucky mate. Out of those approx. 100 crabs i wouldnt want to know how many were females or undersize, this is an utter disgrace. Next we will have some clown on here posting about how they got caught with 80 herring between the two of them and wondering what the were doing wrong. If u fish, its your responsibility to make sure u know the rules and regulations, along with the associated consequences if u break the rules.

Do your research before you go. Know the regulations and catch limits. Suck it up and pay the fine, you shouldnt have been so greedy and ignorant. That fine is bugger all you should've been fined more in my opinion, ignorance is no excuse. 6 of you guys crabbing and not one of you knew the regulations? No sympathy here. Reading and seeing this kind of shit really gets my blood boiling.

Well you won't do that again will ya Piggie? I'm glad the fisheries stopped you as the blue manna crab is an icon to mandurah and it needs to be treated with respect. I have a feeling you didn't even have a fishing license....$1000+ fine is alot of money but highlights the seriousness of the incident. Could easily have been a heavier fine. Make sure you and your mates learn from it and move on.
Do the right thing and there will be fish tomorrow.
