Im all for this crime getting punished but the story (to me) read that there were no witnesses, no video/pics and Fisheries were not present.
Certainly he may have been stealing "a cray" and Im not casting any aspertions on this particular case.
But is it really that easy to catch someone doing that and have them fined $12K and lose their boat?
Best be careful next time someone yells at you on the water and you "give them the finger" or "throw a sinker at them", or you cut them off at the ramp.
If they only need to tell Fisheries a plausible story, there could easily be a couple of innocent people amongst the multitude caught doing this over the last couple of seasons.
Fisheries have demonstrated already that they are unwilling to back down no matter what...
I’m going to assume that since this was a penalty handed out in court for what is presumably a criminal charge, that the magistrate was doing his job and took into account all the evidence and testimony to make his decision. Far cry from being handed a penalty because someone reported you.
If you try some bullshit story and admit during your testimony (and likely to Fisheries initially) that you pulled someone else's cray pot out of the water you're kinda leaving yourself open to whatever punishment comes your way.
